Help/FAQOpenSeats Privacy Policy OPENSEATS.COM ("OpenSeats" or the "Exchange") is a local ticket exchange ("OpenSeats" or the "Exchange") which is owned and operated by OPENSEATS, INC., a Tennessee corporation (the "Company"). OpenSeats has created this privacy statement in order to demonstrate our firm commitment to your privacy. This Privacy Policy explains the policies put in place and used by OpenSeats to protect your privacy as you visit and use the web site. We have prepared a detailed Privacy Policy to help you understand OpenSeats' practices, and enable you to make an informed decision about the site. Your use of the Exchange constitutes an acceptance of the General User Agreement and Privacy Policy. As described below, certain information that you provide to us may be disclosed to third parties, and used by the Company and/or such third parties. Your acceptance of the General User Agreement and Privacy Policy is your express consent to our use and disclosure of your personally identifiable information. PLEASE NOTE MINORS, DEFINED AS ANYONE UNDER THE AGE OF EIGHTEEN (18), ARE NOT ELIGIBLE TO USE THE EXCHANGE AND CORRESPONDINGLY SHOULD NOT SUBMIT ANY PERSONALLY IDENTIFIABLE INFORMATION. IF YOU ARE A MINOR, YOU MAY USE THIS SITE ONLY THROUGH A PARENT OR LEGAL GUARDIAN. The information we collect. Because we operate as an exchange, or classifieds, service, OpenSeats is not set up to collect a lot of personally identifiable information about its users. When you register, we require you to provide your full name and address, your email address, and a password and user id. You may opt to provide your telephone number, which would be visible on your ad posting. Providing your phone number enables a potential buyer to more easily contact you. In addition, if you post ads on our site, we will maintain a file regarding your postings. DO NOT DISCLOSE YOUR USERNAME OR PASSWORD TO ANY THIRD PARTY, OR YOU MAY LOSE CONTROL OVER YOUR PERSONALLY IDENTIFIABLE INFORMATION AND MAY BE SUBJECT TO LEGALLY BINDING ACTIONS TAKEN ON YOUR BEHALF. If you do lose control of your password and/or username, you should immediately change your password and/or username as set forth in Update User Profile. We also collect information about you in Feedback System. If you leave feedback for other users, we will collect such information about you as you choose to disclose. In addition, we collect other user comments about you and your selling behavior as may be provided. While you use OpenSeats, we track certain information about your browsing patterns, including the URL that you just came from (including a URL not on our site), which URL you go to when you leave our site, what browser you are using and your IP address. Many sites automatically collect this information. How we use this information. Internally, we use your personally identifiable information to improve our marketing and promotional efforts, to statistically analyze site usage, and to improve and customize OpenSeats' content and ticket offerings. We believe that this will enable us to better meet your needs. We may also use the personally identifiable information you provide to use, as well as our tracking of your ad posting behavior, to send you emails that may be targeted to your interests. Such informational emails may include targeted banners and promotions. If at any time you wish not to be contacted by OpenSeats regarding targeted promotions and/or information you may write to us at comments@openseats.com. We will also use your email address, and in certain situations your address and/or phone number, to contact you regarding administrative notices from time to time. We also reserve the right to use any and all information in our files, as well as other information we obtain about you, for dispute resolution, troubleshooting, and to enforce our General User Agreement. We may also use the information in our files to determine if users are using multiple usernames or aliases. Disclosure to Third Parties. We will not sell or lease your personally identifiable information to third parties. We may, however, aggregate certain information regarding our users and disclose such information to potential advertisers or use such information for other marketing and/or promotional purposes. Such aggregate information will not contain information which would personally identify you. When you post an ad on OpenSeats you necessarily disclose identifiable information to third party users of the Exchange. This information is provided to allow potential buyers to contact you to negotiate a purchase of tickets. However, other third parties may use this information to send you unsolicited mailings and/or track your use of the Exchange. Third parties will be able to see your postings on the Exchange, your feedback rating and associated comments, etc. In addition, OpenSeats will cooperate with all law enforcement and/or legal inquiries and with all third parties to enforce intellectual and other property rights. Such inquiries may include disclosure of your personally identifiable information. We can, and by use of this site you authorize us to, disclose any information about you to law enforcement and other government officials as we, in our sole discretion, believe necessary or appropriate. General. This Privacy Policy pertains solely to the use by and collection of information on OpenSeats. These policies do not apply, and OpenSeats has no control over any information you disclose to third parties, whether they are buyers or sellers on our Exchange or third party advertisers adhering to their own privacy rules. You should always be careful before disclosing personal information to any third party. OpenSeats uses industry standard security measures to protect the loss, misuse and alteration of the information under our control. However, due to the nature of the internet OpenSeats can not guarantee that all of your private communications, or personally identifiable information may never be disclosed in ways not anticipated or discussed in this Privacy Policy, such as a third party unlawfully intercepting or accessing a transmission. OpenSeats reserves the right to incorporate changes or modifications to this Privacy Policy, which shall be effective upon posting. This Privacy Policy is incorporated into and subject to the terms and conditions of the General User Agreement.
